Welcome to www.kkherbalist.com (the “Website”). These Terms of Use ("Terms") form a legally‑binding agreement between you ("you/your") and Sage Herbal Medicine Ltd (trading as Karine Knox‑Humbert, Medical Herbalist) ("we/us/our"). By accessing or using any part of the Website you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Website.

2 Changes to these Terms

We may amend these Terms at any time by posting an updated version on the Website. The “Last updated” date above will change. Your continued use of the Website after amendments are posted constitutes your acceptance of the revised Terms.

3 Definitions

“Content” – all text, graphics, audio, video, information and other material on the Website.
“Services” – the informational services provided through the Website and any online booking or payment facility we may make available.
“Consultation” – an appointment for a professional herbal‑medicine consultation provided by us, whether booked online, by e‑mail or by phone.

4 Electronic communication

When you send e‑mails or complete online forms, you are communicating with us electronically. You consent to receive communications from us electronically and agree that all notices and disclosures provided electronically satisfy any legal requirement that such communications be in writing.

5 Website availability

We do not guarantee that the Website, or any Content, will always be available or uninterrupted. We may suspend, withdraw or restrict availability for business and operational reasons.

6 Intellectual‑property rights

Unless otherwise stated, all intellectual‑property rights in the Website and its Content are owned by Sage Herbal Medicine Ltd or our licensors and are protected by UK and international copyright, trade‑mark and database‑right laws. You may view, download for caching purposes and print one copy of any page for your personal, non‑commercial use. You must not:

republish, sell, rent, sub‑license or reproduce any Content for commercial purposes;
modify or adapt any Content; or
remove any copyright, trade‑mark or other proprietary notices.

7 Medical & health disclaimer

The Content is provided for general information only and is not intended to replace the advice of your GP or any other qualified healthcare professional. Do not disregard professional medical advice or delay seeking it because of anything you read on this Website. If you believe you may have a medical condition, consult your GP promptly.

No Client‑Practitioner relationship is formed merely by reading the Website or sending an enquiry; such a relationship arises only when you book a Consultation and we confirm your appointment in writing.

8 Reliance on information & user responsibility

We make reasonable efforts to update the information on the Website, but we make no representations, warranties or guarantees that the Content is accurate, complete or up to date. You rely on information obtained from the Website entirely at your own risk.

9 User account and security

If you create an account or password on any part of the Website, you must keep that login confidential and not share it with any third party. We may disable any user identification code or password at any time if we reasonably believe you have failed to comply with these Terms.

10 User‑generated content

Where the Website allows you to post or upload content (for example, comments on a blog), you agree that you will not post anything unlawful, defamatory, obscene or infringing. You grant us a perpetual, worldwide, royalty‑free licence to use, reproduce and edit any material you submit for the purposes of operating and promoting the Website. We reserve the right to remove any user‑generated content at our discretion.

11 Acceptable Use

You must not use the Website:

in any way that breaches applicable local, national or international law;
to transmit unsolicited or unauthorised advertising or spam;
to knowingly transmit viruses or other malicious code;
to harvest data or conduct data‑mining without our consent.

12 Booking consultations online

We may provide an online booking facility (directly or via a third‑party platform). By booking a Consultation you agree that:

The appointment is provisional until we send written confirmation.
You will complete our separate Client Intake & Consent Form before your first Consultation.
Fees are payable in advance unless we agree otherwise in writing.
Cancellation policy – you may cancel or reschedule up to 24 hours before the appointment time for a full refund. Cancellations made with less than 24 hours’ notice may be charged in full.
The Consumer Contracts Regulations 2013 (14‑day “cool‑off”) do not apply where you request an appointment to take place within that 14‑day period and we have fully supplied the service.

13 Prices & payment

All fees are listed in GBP and, unless stated otherwise, are exempt from VAT (or include VAT if we become VAT‑registered). You are responsible for any bank or currency‑conversion charges.

14 Refunds

If we cancel a Consultation you have paid for, we will offer you a new date/time or a full refund at your choice. Refunds will be processed using the original payment method within 14 days.

15 Newsletter & marketing

If you opt in to our newsletter we will use your e‑mail address to send occasional news and offers. You can unsubscribe at any time via the link in each e‑mail or by contacting us at the Contact Details.

16 Third‑party links & resources

The Website may contain links to third‑party sites or resources. These links are provided for information only. Such links should not be interpreted as approval by us of those websites or information. We have no control over the contents of those sites.

17 Idea submissions

We do not accept unsolicited ideas or proposals relating to herbal formulations or business methods. If you submit an idea, you agree that we may use it freely without compensation.

18 Accessibility

We aim to make the Website conform to WCAG 2.1 AA guidelines. If you experience difficulty accessing content, please contact us via the Contact Details and we will provide the information in an alternative format.

19 Privacy

Personal data collected through the Website is processed in accordance with our Privacy Notice. The Website sets no non‑essential cookies until you provide consent via our cookie banner.

20 Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

Subject to that, we shall not be liable for any loss of profits, business interruption, loss of business opportunity, goodwill or data, or for any indirect or consequential loss arising out of or in connection with your use of the Website or reliance on any Content.

21 Indemnity

You agree to indemnify and hold harmless Sage Herbal Medicine Ltd, its directors and employees from and against any claims, liabilities, damages, losses and expenses (including legal fees) arising out of your breach of these Terms or your misuse of the Website.

22 Termination & suspension

We may suspend or terminate your right to use the Website immediately if we reasonably believe you have breached these Terms. Upon termination the provisions which by their nature should survive will continue to apply, including Sections 6, 7, 20 and 21.

23 Events outside our control

We will not be liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including (without limitation) acts of God, war, cyber‑attack, epidemic or failure of telecommunications networks.

24 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

25 Entire agreement & assignment

These Terms constitute the entire agreement between you and us regarding the Website and supersede any previous agreements. We may transfer our rights and obligations under these Terms to another organisation; you may not assign your rights without our consent.

26 Governing law & jurisdiction

These Terms, their subject matter and formation are governed by the laws of England and Wales. You and we agree to the exclusive jurisdiction of the English courts.
